Activision countersues: West and Zampella delayed Modern Warfare 3 pre-prod

The main story should have been the countersuit filed by Activision against ex-Infinity Ward big bosses, Jason West and Vince Zampella. However, focus quickly shifted to something else more enticing than this legal drama, and all it took was a mention of “Modern Warfare 3.”

 

 

In the countersuit filed by Activision this morning, the document was relating how both West and Zampella breached their 2008 Memorandum of Understanding (MOU), which essentially required Activision to get West and Zampella’s written consent for any decision concerning the Modern Warfare brand.

 

 

For their end, though, the IW heads were “prohibited from withholding such consent unreasonably or in bad faith.” The countersuit further alleged that the duo withheld their consent for their own gain, because it was already in their plans to leave Activision and start their new company.

 

 

If you thought that was juicy, wait till you get this:

 

“Among other things, they delayed pre-production of Modern Warfare 3 and attempted to improperly leverage their rights under the MOU to obtain further advantages for themselves and concessions from Activision.”

 

The countersuit continues:

 

“As a direct and proximate result of this breach of covenant of good faith and fair dealing, Activision has been forced to commit additional resources to Modern Warfare 3, institute litigation to seek a declaration of rights, and incur costs and attorneys’ fees, and will incur additional expenses in connection with securing the benefits of the MOU.

 

Accordingly, Activision has been damaged as a result of West and Zampella’s actions in an amount to be proven at trial.”

 

You read that guys? Modern Warfare 3 is in development!!!
