Activision gets sued for Guitar Hero III band cover and sound problems - Image 1Even though Activision‘s Guitar Hero III (Microsoft Xbox 360, Sony PlayStation 3, Nintendo Wii, PC) is still one of the hottest selling games in  the market, we all know that problems hounded the game’s rise to stardom ever since it debuted in October. Things haven’t eased up for Activision even with the holidays practically arriving, as lawsuits continue to chase its little rock star.

Activision was named in a class-action suit filed by Samuel Livingston of San Diego, accusing the developer that it allegedly misled consumers to believe that their copies of Guitar Hero III  for the NIntendo Wii were that of the Dolby Pro Logic II version when the games were only able to produce mono mono sound output when played.

Aside from “seeking  actual damages, individual restitution, equitable relief, civil penalties, costs, and expenses in litigation,” the lawsuit that Livingston filed which was represented by the KamberEdlson law firm also accused Activision that the company made no attempts to address these issues.

Wired was able to get a comment from an Activision representative about the replacement of the game copies with remastered copies of Guitar Hero III for the Wii. The publisher didn’t give any comment regarding the lawsuit though.
