You’ll recall that back in February, Activision threatened to sue Electronic Arts over Brütal Legend, to which an EA rep replied that that would be like “a husband abandoning his family and then suing after his wife meets a better looking guy.”

Yeah, well, the husband actually went and sued the wife. Activision has formally filed a lawsuit against Double Fine Productions to put a stop to the release of Brütal Legend.

According to the Associated Press, Activision claims that it still owns the rights transferred by Double Fine to EA when the latter picked the game up for publication. Activision claims it still has a valid contract to release the game and has invested roughly US$ 15 million in it.

Activision, Double Fine and EA have yet to comment on this development. The game is supposed to be released on PS3 and Xbox 360 this October, but this lawsuit could affect that launch date.
