GTA: San Andreas - Image 1Take-Two finally drafted a proposed settlement to the class action litigation dealing with the Hot Coffee controversy in Rockstar North‘s Grand Theft Auto: San Andreas (for the PC, PS2, Xbox). The settlements involve game disc exchanges and even cash refunds to be given to gamers who bought the title.

Take-Two offers settlement benefits to customers that are offended with GTA: San Andreas‘ Hot Coffee mini-game, and the game publishing outfit has estimated that they will spend anywhere between US$ 1 million and US$ 2.75 million. Consumers will have to swear the following if they want to qualify for the settlement benefits.

That they:
1) bought a copy of Grand Theft Auto: San Andreas before July 20, 2005
2) were offended and upset by the ability of consumers to modify and alter the game’s content using the third-party Hot Coffee modification
3) would not have bought the game had they known that consumers could modify and alter the game’s content using the third-party Hot Coffee modification
4) would have returned the game, upon learning the game could be modified and altered, if they thought this possible

This settlement proposal has to be approved by the court first. When approved, the full details pertaining to the requirements to receive a game disc replacement or cash refund will most likely be provided to the public.
